Bharatiya Sakshya Adhiniyam (BSA) 2023

The Bharatiya Sakshya Adhiniyam 2023 (BSA) has fundamentally altered the standards for electronic evidence in India, replacing the legacy Indian Evidence Act (IEA) 1872.

For the modern Advocate, the BSA represents both a challenge and an opportunity.

The Section 63 Standard (Formerly Section 65B)

Section 63 of the BSA (corresponding to the erstwhile Section 65B IEA) establishes the requirements for the admissibility of electronic records. The core shift under the new law is an increased judicial focus on Authenticity and Integrity.

Litigation teams must now be prepared to address:

  1. The Origin of Record: Proof that the file was generated or received in the ordinary course of business.
  2. Integrity during Storage: Proof that the file has remained unchanged throughout its history while in the proponent's custody.
  3. Technical Declaration: A certificate signed by a person in a responsible position, backed by technical logs.
